Shahzeb Case - Feudalism Won

By Kanza Jamil - 27 Oct 2018

Imagine going through all the pains and risks of pregnancy and labor, building a family, raising a child to be a decent adult and then watching him get murdered for trying to defend the honor of sister, because some rich, spoiled boy thought he could get away with it.

And then actually having to let that boy get away with this because he actually has too much money and power, enough to make you fear for the safety of your other children. Imagine being the parent of a murdered child and watching the murderer get a happily ever after because HIS parents were rich.

This is the story of Aurangzeb Khan and Ambreen Aurangzeb, the parents who lost their twenty year old son to the murderous privileges of Shahrukh Jatoi, son of a feudal landlord family in Pakistan.

Shahzeb Khan was shot to death at the age of twenty by Shahrukh Jatoi and Siraj Talpur with the aid of Sajjad Talpur and Ghulam Murtaza Lashari, on 25 December 2012 in Karachi. Shahzeb was gunned down for trying to protect his sister against sexual harassment on their way home, leaving his old parents and two sisters to face the pains and pressure of an insanely biased system, cunningly designed to protect the rich and the corrupt against desperate cries of their victims.

Shahzeb Khan was the only son of Deputy Superintendent of Police Aurangzeb Khan and his wife Ambreen Aurangzeb, a bright student of media sciences at Greenwich University and the future of the country, murdered for not submitting to the horrific injustices of feudalism in Pakistan.

On that faithful night while returning home in Country Club Apartments from his sister’s wedding with his other sister, Shahzeb made the deadly mistake of crossing paths with Shahrukh Jatoi and his friends/servants who started throwing sexual slurs at his sister in front of him. Shahzeb, reacting in a way that any decent person it's supposed to act, firmly ask them to stop, Shahrukh, drunk in his privileges and the power of his family name, unable to fathom how dare anyone defy his entitlement over everyone and everything in this country, launched a physical assault on the boy.

A fight broke out between Shahzeb Khan and Shahrukh Jatoi and his friends, Shahzeb fighting for his right to protect his sister and Shahrukh fighting for his privilege to assault or harass anyone he wants in the family’s power and feudalism in Pakistan. Shahzenb’s father, DSP Aurangzeb Khan sensing the danger of his son standing to this feudal landlord, quickly intervened to resolve the conflict and seemingly succeeded on a good note. But unfortunately, the worst was yet to come.

After Shahruk Jatoi and his friends left And everything appeared resolved and normal, Shahzeb, oblivious to the lingering danger and vengefulness of this Sindhi landlord, decided to have tea with is friends.

He drove in his gleaming blue Swift which was an early birthday gift from his parents, near Mubarak Masjid, where Talpur and his friend Shahrukh Jatoi followed him, along with Jatoi’s armed guards and started shooting at the car.

Four 9mm bullets pierced through his car to enter his body, leaving him severely injured and eventually murdered, silencing the voice of anyone who ever dared to have a voice against the corrupt power of feudalism in Pakistan. According to several records claiming that after mowing down Shahzeb Khan, Shahrukh Jatoi went back to shoot more bullets into the injured twenty year old to make sure he never wakes up.

The devastated family tried to register FIR but they had to face a hard time at even so simple a task because of the heavy political pressure.

Finally managing to register FIR 519 under murder case 302 at the Darakhshan Police Station against the two accused and their guards, but still the investigation for murder of 20 year old son was still suspiciously slow and by the time it reaches somewhere, Sharukh Jatoi had fled the country with this family to Dubai on false documents.

The violent scenario and the appallingly unjust aftermath causes a social uproar in favor of the dead youth, Shahzeb’s family and friends held several protest with the help of activist and thousands of common people of Pakistan, They held protests and used Twitter and Facebook to spread word about the case.

Protests were also organized by Imran Khan's PTI party against feudalism in Sindh. On 1st January 2013, all the effort and courage in the way of justice led Chief Justice of Pakistan to take suo moto notice of the case. On 5th January, IG police issued Red Warrant for Sharukh Jatoi’s arrest.

After arresting Sharukh’s friends who aided in Shahzeb’s murder on 7th January, police kept them on remand until 17th January, when Shahrukh was brought back from his refuge in Dubai and sent to jail on 18th January, 2013. The trials begun on 26th January and Jatoi’s expensive lawyers claimed him to be a minor and demanded him to be transferred to Juvenile.

They argued against Jatoi’s trial as an adult for their claims of him to be under eighteen years of age. However the Ossification test results on 7th February proved those claims to be false and forced Jatoi to face the courts as an adult. On the fateful day of 7th June, 2013, an Anti-Terrorism Court (ATC) finally awarded death penalty to Jatoi and Siraj Talpur for Shahzeb's murder. Siraj's younger brother Sajjad Ali Talpur and his servant Ghulam Murtaza Lashari were sentenced to life imprisonment.

But the story wasn’t over yet, only after a few months of Jatoi being sentenced to death by ATC, on 29th September 2013, He was pardoned by Shahzeb’s parents, and the copy of an agreement stating that they have not accepted the blood-money was submitted in the court.

This decision however was fiercely opposed and even bashed on several media platform but the activists and supporters who came out of their homes to find Justice for Shahzeb’s murderers, upset that their efforts were in vain.

Ambreen Aurangzeb, Shahzeb’s mother however stated, “We cannot spend our entire lives in fear, we took the decision considering the circumstances.” while Sharukh’s brother, Ashraf Jatoi boasted to the media that “Shahzeb’s family forgave (Shahrukh Jatoi) in the name of Allah. They didn’t take any cash”

The pardon still wasn’t the end of it, despite the pardon, the death penalty was upheld because of the addition of terrorism charges to the case.

However, the SHC recently disregarded the death penalty and ordered a retrial of the case in a sessions court after a criminal review petition filed by Jatoi's lawyer argued that terrorism charges needs to be dropped because the main suspect was a juvenile at the time of the offence, even though they had already made that claim and were proved to be liars about it.

The obejection was based on the fact that the trial was held at an anti terrorism court instead of a regular court, Jatui’s lawyer, Advocate Farooq H. Naek argued that the conflict and murder was the result of personal issue and enmity and therefore the trial should never have been held in ATC.

On, 16th August, 2016, High Court of Sindh reconsiders his appeal for a retrial in Juvenile court, and then again on 28th November 2017, SHC revokes the punishments previously awarded to reopen the case.

The release orders for Shahrukh Jatoi, Siraj Talpur and Sajjad Talpur was issued by the court after submission of surety bonds of about half a million rupees, each. Jatoi was also released on bail in the case of possession of arms after submitting surety bond of one lack rupees.

In January 2018, Supreme court nullifies the order of Sindh high court and orders a retrial of the murder case.

The judge issued orders of production of the suspect after the appearance several rumors reporting the multiple sights of Sharukh Jatoi travelling out of the country on fraudulent documents resumed. Jatoi’s counsel however, denied any claims of such occurrence, and told the court that his client is still in jail on the Supreme Court’s orders. The record form the jail authorities were then summoned by the court to test those claims. However jail authorities refused to produce Sharukh Jatoi.

Facing the tremendous social pressure and threats the corrupted power of Pakistan, Shahzeb’s father Deputy Superintendent of Police Aurangzeb Khan left this world for the peace of the afterlife on 23rd October 2018, in New Zealand after a brief illness. On 24th October 2018, Supreme court heard Sharukh Jatoi’s lawyer, Mehmood Qureshi about the contradictions in the FIR and eye witness’s statement.

Even though we all know that human memory is only 62% accurate and minor details such as color and shapes can be altered by human mind when the memory is old, but definitely not the traumatizing memories of who murdered who. The next trial is set to be on 5th November, 2018.

A brilliant young boy was murdered in 2012, in front of several witnesses and six years later, we still haven’t manage to decide if his murdered should be punished. Shahzeb’s parents fought back, there were witnesses to the crime, the case has been through Anti Terrorism Court, Sindh High Court and is now completing its tour through Supreme Court and justice is still nowhere on the horizon.

This one case alone portrays the perfect image of the ugly truth about violence and power and corruption in this country and what even more horrifying, is the idea that this is just one case and there are about a thousand more without the media coverage. This barbaric act performed by ShahRukh Jataoi sindhi gangster and his friends is still not justified and feudalism aka Waderaism prevails where in a country there is no justice.

Imran Khan my question to you, how will you bring the change when everything can be bought by money and these feudal lords can kill anyone they want and where justice is not served ?

That was bold and blunt. If I was to give it a title I'd rather chose "Feudalism - The Hardest Fight" or something like that. "WON" is a word too weak and sounds like accepting the defeat already. What's the point of making it vivid if the verdict is "Impossible to fight". I followed this for years and I still hope cases like this will end in favor of the common and in the end Justice will prevail.
